This step is only applicable if the planning team is preparing an environmental impact statement (EIS).  If an environmental assessment is being prepared in lieu of an EIS, publication of a notice of intent to prepare an environmental impact statement  in the Federal Register is not required.  The notice of intent (NOI) should reference the notice of scoping published in the second step, Publish Notice of Scoping in Federal Register, as well as the scoping undertaken in the interim.
