SERVICEWIDE LAWS AND POLICIES - Rights-of-Way and Telecommunications Infrastructure

Current laws and policies require that the following conditions be achieved in the park:
   

Desired Condition: Park resources or public enjoyment of the parks are not denigrated by nonconforming uses.Telecommunication structures are permitted in the parks to the extent that they do not jeopardize the park's mission and resources.No new rights-of-way will be permitted through the parks without specific statutory authority and approval by NPS management and only if there is no practicable alternative to such use of NPS lands.

The Telecommunications Act of 1996 directs all federal agencies to assist in the national goal of achieving a seamless telecommunications system throughout the U.S. by accommodating requests by telecommunication companies for the use of property, rights-of-way, and easements to the extent allowable under each agency's mission. Unlike other nonconforming uses, the National Park Service is legally obligated to permit telecommunication infrastructure within the parks if such facilities can be structured to avoid interference with park purposes.
